Why Now?

The Department of Labor (DOL) has made it exceedingly clear that MHPAEA compliance and the new NQTL analyses are at the top of its 2021 enforcement list. In fact, DOL is already collecting NQTL analyses and issuing findings.

In April 2021 the DOL, Health and Human Services and the Treasury published FAQs about how the MHPAEA will be implemented as a result of the Consolidated Appropriations Act.

Who Should Watch?

Self-insured employers with 500+ employees and brokers who represent these employers. MHPAEA applies to employers with 51+ employees, but the aforementioned group has a greater compliance risk.
